Naïades Locations

Between the Customer and NAIADES LOCATIONS

1. The Client undertakes (as well as any occupant or guest) to respect these General Conditions and all the rules and regulations relating to the Property. NAIADES LOCATIONS and/or the managers of the building reserve the right to evict the Client following misconduct on his/her part or a breach of these General Conditions or the said rules and regulations.

2. NAIADES LOCATIONS reserves the right to inspect, repair, redesign and maintain all villas or flats, with prior notice given as soon as possible. In the event of technical or maintenance problems, NAIADES LOCATIONS reserves the right to relocate or upgrade the Customer to a villa or flat located in the same area or nearby without any compensation or claim from the Customer.

3. Animals are not permitted in the designated villas; in the event that it is found that the Customer has brought any animal into the rented villa, the CUSTOMER will be held responsible for all damage caused in the villa and in the communal areas of the Property; NAIADES LOCATIONS may terminate the reservation if any Customer refuses to comply with the said request.

4. The Client shall reimburse replacement costs in the event of loss of keys, gate passes/boxes, garage door opening pass/box (these costs will be charged to you for all items not returned at the time of the departure inventory), or in respect of any damage caused to the villa or its furniture or furnishings or to the common areas of the Property following an act of negligence, lack of care or misuse on the part of the Client, any occupant or guest (including any additional cleaning or repairs required, at the sole discretion of NAIADES LOCATIONS).

5. The Client agrees to take care of the villa and not to carry out any dangerous, improper or illicit activity in the villa and in the common areas of the Property. The Client agrees to obtain and/or maintain his/her own insurance and/or to be responsible for his/her personal belongings and those of any occupant or guest. The Client accepts and acknowledges that NAIADES LOCATIONS shall not be responsible for the safekeeping of any material, supplies, written documents or other valuables left in the flats or in the common areas of the Property even in the event of theft following or not following a break-in. The Client may not rely on any verbal or written statement made by NAIADES LOCATIONS staff in this respect.

6. The CUSTOMER acknowledges that he/she will not use the villa for festive or noisy parties. The CUSTOMER acknowledges that he/she will take care not to behave in a way that could cause a nuisance to the neighbourhood. Under no circumstances does the CUSTOMER intend to use the villa for parties, birthdays, family reunions or any other type of event that could result in the use of sound equipment that could disturb the surrounding environment.
tHE NON-RESPECT OF THIS ARTICLE OR ANY COMPLAINT FROM NEIGHBOURS WOULD BE A CLAUSE ALLOWING THE CANCELLATION OF THE PRESENT CONTRACT WITHOUT ANY REIMBURSEMENT OF THE AMOUNT OF THE RENTAL WHICH WOULD REMAIN DUE AS DAMAGES TO THE BENEFIT OF THE COMPANY NAIADES LOCATIONS.

7. CONDITIONS OF RESERVATION The reservation of the premises of the company NAIADES LOCATIONS only constitutes a reservation when the information relating to the confirmation has been accepted by the company NAIADES LOCATIONS. In order to validate the reservation, the elements relating to the confirmation must be: - To have paid at least 50% of the total amount (including tax) of the rental period of the villa to the company NAIADES LOCATIONS The Client may not assign, sublet or transfer the Reservation Confirmation, the villa or any part thereof, nor allow its use by anyone other than the Client and his authorised occupants.

8. The Client shall defend, indemnify and hold NAIADES LOCATIONS harmless against any claims, losses or expenses arising from the use by the Client, any occupier or guest of the villa or the communal areas of the Property.

9. BOOKING CHANGES: NOTICE OF EXTENSION OF STAY OR CANCELLATION

EXTENSION: Any postponement of the departure date must be notified in writing to NAIADES LOCATIONS, subject to availability and approval by NAIADES LOCATIONS. The reservation may be extended without the obligation to keep the resident in the same villa or at the same rate for the night. If NAIADES LOCATIONS accepts an extension, the new rate granted will not have retroactive effect. Any postponement of the departure date is subject to availability and approval by NAIADES LOCATIONS.

Any UNAUTHORISED occupation beyond the dates approved by NAIADES RENTALS will be invoiced at double the daily, weekly or monthly rate then in force for the said extension of stay.

CANCELLATION: Requests for cancellation must be made in writing. Bookings may be cancelled in accordance with the conditions specifically provided for in this contract on page 2. For all cancellations or reductions in the length of stay notified after the date of arrival, payment for the entire period remains due and cannot be refunded.

10. PAYMENT CONDITIONS Full payment in cash at the time of booking in order to validate the booking. Payment must be made for the full amount including VAT for the period rented when the keys are handed over and the CLIENT enters the villa. NAIADES LOCATIONS will invoice the CLIENT for the full amount of the stay within 8 days of the CLIENT leaving the villa.

11. An inventory will be drawn up between the CUSTOMER and the representative of NAIADES LOCATIONS when the CUSTOMER enters the villa. The resident may check the said inventory on arrival and notify NAIADES LOCATIONS of any item missing or damaged on entering the villa. No claim will be possible at a later date and NAIADES LOCATIONS will consider the inventory to be complete. On the day of the resident's departure, NAIADES LOCATIONS will use the inventory in question to check the condition of the villa and the presence of all the furniture and supplies.

12. The Client authorises NAIADES LOCATIONS to obtain a credit report from one or more consumer credit reporting agencies. NAIADES LOCATIONS may request this report at any time during the Client's stay in a flat managed by NAIADES LOCATIONS and the Client's reservation may be subject to minimum credit levels. The Client accepts that if a minimum credit level is not obtained, the reservation may be cancelled.

13. The Client may not assign, sublet or transfer the Booking Confirmation, the villa or any part thereof or permit it to be used by anyone other than the Client and its authorised occupants.

14. Le Client déclare, garantit et s’engage à l’égard de la société NAIADES LOCATIONS que son utilisation et son occupation de l’appartement revêtent un caractère passager et qu’il n’a pas l’intention d’utiliser la villa à titre permanent. L’occupation et l’utilisation de cette villa par le Client ne devront en aucun cas être interprétées comme créant une relation propriétaire/locataire entre la société NAIADES LOCATIONS et le Client. Le présent Contrat n’est pas un contrat de bail et ne confère au Client aucun droit de propriété immobilière ni droit réel immobilier sur la villa ou toute autre partie de la Propriété. 15. Délogement : dans le cas de délogement nécessaire, la société NAIADES LOCATIONS informera immédiatement le Client par E-mail et/ou par téléphone et proposera un autre appartement de catégorie identique ou supérieure dans une des résidences NAIADES LOCATIONS ou auprès d’un partenaire.
